Austin Logistics Loses Injunction, Drops Lawsuit Against

Studies), Inc., a leading provider of contact center software solutions, today announced that Austin Logistics Incorporated (ALI) dropped its trademark suit
against Positive Software Systems after losing a preliminary injunction proceeding in Texas state court.
Austin Logistics filed a lawsuit in Texas state district court in Travis County, Texas, on September 25, 2003. Austin Logistics asserted that its "OnQ" name was
confusingly similar to Positive Software Systems' ContactQ mark. As part of the lawsuit, Austin Logistics requested a preliminary injunction barring Positive Software
Systems from using the ContactQ mark for its recently launched customer interaction data warehouse (CIDW) solution. On November 18, 2003, the court denied Austin
Logistics’ request for preliminary injunction, and three days later, Austin Logistics voluntarily dismissed its lawsuit.
